2. Scope

These terms of sale (CGV) apply to sales of wine made between TRANS VINS and the buyer following a quote request made on this site, by email or by telephone. They can be reached from every page of the site, and the buyer reads them before placing an order.

Accepting a quote means accepting these terms, to the exclusion of any other document (leaflets, catalogues), which is for information only. The fact that TRANS VINS does not rely on one of the provisions below at a given time does not mean it waives the right to rely on it later.

Offers and these terms apply to delivery in mainland France. For delivery abroad, contact us: costs and conditions differ by country.

3. Quote and order

The calculators on the site give estimates. Only the quote drawn up by TRANS VINS is binding: it names the wines, the vintages, the quantities, the prices and the shipping costs.

The order is formed when the buyer accepts the quote in writing (email or letter) and TRANS VINS confirms it. TRANS VINS contacts the buyer again to validate the order and agree on payment.

4. Prices

Prices are in euros. For each wine, the quote shows the price excl. VAT and incl. VAT, and the shipping costs on a separate line.

A detailed invoice comes with the delivery.

5. Availability

Offers are subject to prior sale. As some wines are rare, the lists shown on the site are for information only, and TRANS VINS cannot be held liable for a wine being out of stock, temporarily or permanently. The buyer is told as soon as possible and may then choose another wine or cancel the line concerned.

Orders are filled in the order in which payment is received. Some wines are subject to a minimum order, stated on the quote.

6. Shipping costs

Shipping costs excl. VAT depend on the delivery address and the quantity ordered. For mainland France:

1 to 12 bottles: €28
13 to 24 bottles: €32
25 to 36 bottles: €33
37 to 48 bottles: €39
49 to 60 bottles: €41
61 to 72 bottles: €46
73 to 84 bottles: €48
85 to 96 bottles: €52
97 to 108 bottles: €57
109 to 120 bottles: €61

Above 120 bottles, shipping costs are priced on the quote.

7. Payment

The price is payable in full on ordering, by cheque in euros made out to TRANS VINS, sent to 19 rue Édouard Faure, 33300 Bordeaux, or by any other means stated on the quote. The order is shipped only once payment has been received.

8. Delivery

Delivery is made by carrier to the address given by the buyer or, if the buyer is absent, by a notice that the goods are available for collection. The lead time depends on the delivery address; it runs from receipt of payment and does not exceed thirty (30) days. If this lead time could not be met, the buyer would be told as soon as possible and could ask for the products to be exchanged or refunded.

The delivery is handed to an adult.

9. Transport and receipt

Goods are checked before shipping. The risk of loss or breakage passes to the buyer when the buyer takes physical possession of the products, or when a third party designated by the buyer, other than the carrier offered by TRANS VINS, takes possession of them.

On receipt, check the contents of the parcels in the presence of the delivery driver and write any specific reservation (breakage, missing parcel, damaged case) on the delivery note, then report it to TRANS VINS within three (3) days by email or letter, with photos if possible.

10. Right of withdrawal

A buyer who is a consumer has fourteen (14) days from receipt of the products to withdraw, without having to give a reason (articles L221-18 et seq. of the French Consumer Code). The buyer gives notice of the decision by an unambiguous statement, by email to mail@transvins.com or by letter to the registered office, for example using the model form below.

The products are returned to the registered office within fourteen (14) days of this notice, at the buyer's expense, complete, in good condition and in their original packaging, with the invoice. TRANS VINS refunds the sums paid, including the original delivery costs (based on the standard delivery method), within fourteen (14) days of the notice; it may withhold this refund until it receives the products or proof that they have been sent.

The right of withdrawal does not apply to alcoholic drinks whose delivery is deferred beyond thirty days and whose value depends on market fluctuations, such as wines bought en primeur (article L221-28, 12°).

11. Legal guarantees

The products are covered by the legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code). The natural development of a wine with age (sediment, fill level in the bottle, colour) is not a lack of conformity when it is normal for its vintage.

Unopened bottles not drunk at the end of an event are not taken back, except where the right of withdrawal is exercised.

12. Retention of title

TRANS VINS remains the owner of the products until the price has actually been paid in full. Full payment transfers ownership.

13. Protection of minors

The sale of alcohol to minors is prohibited (article L3342-1 of the French Public Health Code). By placing an order, the buyer declares that they are at least eighteen (18) years old.

Excessive drinking is bad for your health; drink responsibly.

14. Personal data

The information sent through the quote form is used only to answer the request and process the order. It is neither transferred nor sold. The buyer can access it, have it corrected or have it deleted by writing to mail@transvins.com.

16. Governing law and disputes

These terms of sale are governed by French law. If a problem arises, the buyer is invited first to seek an amicable solution with TRANS VINS.

Failing agreement, the dispute is brought before the court for the defendant's place of residence or the place of delivery.
